We note that this is the last scheduled auction under AEP Ohio’s ESP III. We assume that AEP Ohio will be filing an application for ESP IV. Is AEP Ohio considering removing the credit-based tranche cap in its next ESP?
Yes, you are correct that the upcoming March 2017 auction is the final auction in a series of six auctions as approved by the Public Utilities Commission of Ohio (“PUCO”) in Case no. 13-2385-EL-SSO for ESP III.AEP Ohio has recently filed a petition to amend its Electric Security Plan by extending its ESP III (the “ESP III extension”). In this petition, AEP Ohio proposes, among other items, to apply the credit-based tranche cap to each auction separately instead of cumulatively across all auctions under ESP III. Please see page 13 of the Direct Testimony of AEP Ohio’s Witness David B. Weiss dated November 23, 2016 and posted here: http://www.aepohiocbp.com/index.cfm?s=background&p=regulatoryProcess. The PUCO has not yet rendered a decision on AEP Ohio’s petition, which is Case No. 16-1852-EL-SSO. The docket can be accessed via the PUCO’s Docketing Information System at https://dis.puc.state.oh.us/.

The individual serving as Legal Representative, or an individual on behalf of the company serving as Legal Representative, is required to sign the Legal Representative Insert (#P1-4).

FAQ-143:
Can we rely on our guarantor’s financial standing if the guarantor is foreign, but is unable to provide the legal opinion and sworn certificates required under the Master SSO Supply Agreement? Assuming that we cannot rely on a guarantor, what are our options to meet the credit requirements under the Master SSO Supply Agreement if the bidder is not rated and does not have standalone financials? What should the bidder do in its Part 1 Application?
First, you may not rely on a foreign guarantor if you are not able to provide the necessary documents required under the Master SSO Supply Agreement related to foreign guarantors. If the bidder does not meet the Minimum Rating requirement or have financial statements, the bidder has to provide cash or a performance assurance letter of credit to meet the credit requirements under the Master SSO Supply Agreement. For purposes of the Part 1 Application, you may indicate that the bidder is relying on its own financial standing and indicate in the space provided that the bidder intends to meet the credit requirements under the Master SSO Supply Agreement using cash or a performance assurance letter of credit.Please also see FAQ-36 for information.

Please confirm that for the period starting June 1, 2016, the hourly energy data for PIPP Customers is not included as part of the SSO information.
Yes, that is correct. For the period prior to June 1, 2016, SSO hourly energy data includes the load of PIPP Customers. For the period starting June 1, 2016, SSO hourly energy data does not include the load of PIPP Customers. The PIPP hourly energy data and monthly customer counts are provided as separate files for CSP and OPCo zones. Please refer to the Data Description file posted to the data room for more details.

FAQ-134:
With reference to the daily PLC data for SSO Customers posted to the data room, please explain the decrease in the daily PLC data for SSO Customers in June 2016?
AEP Ohio cannot comment on how you analyze the data. Nevertheless, AEP Ohio notes two points. First, PLC tags are updated on an annual basis effective on June 1 each year. Second, starting June 1, 2016 the daily PLC data for PIPP Customers are provided as a separate series in the data file and are no longer included as part of the daily PLC of SSO Customers.

FAQ-132:
Paragraph 4 of the Pre-Bid Letter of Credit requires the issuing bank to make payments into your account within a very short period of time should you draw on the Pre-Bid Letter of Credit. To facilitate the payment process should you need to draw on our Pre-Bid Letter of Credit, will you be able to provide wiring instructions to us in advance?

FAQ-130:
Is the Bidding Agreement Insert (P1-9) required for an applicant that is not part of a bidding agreement, bidding consortium or joint venture?
No, if the Applicant is bidding independently and not as a party to any bidding agreement with another party or through any other arrangement involving joint or coordinated bidding with any other party, the Bidding Agreement Insert (P1-9) is not required.

FAQ-129:
In the Part 1 Application, who is to sign the certification in the Legal Representative Insert (P1-4)?
The certification is to be signed by legal counsel or a representative agent. A representative agent is a business or individual with an address in Ohio that is authorized and agrees to receive service of process on behalf of the bidder. If a company agrees to accept service of process on behalf of the Applicant, the name and the contact information of an individual from that company must be provided in the Part 1 Form and that individual must sign the certification.
